Tastries Bakery owner Cathy Miller may be heading back to court after the Department of Fair Employment and Housing announced their intent to file a civil lawsuit, according to the Freedom of Conscience Defense Fund.
The FCDF, who have represented Miller through a lengthy court process centered around her refusal to create a custom wedding cake for a same-sex wedding celebration in 2017, said the announcement was made after the DFEH "purportedly found more 'evidence'."
"Cathy and her husband are steadfast in defending their faith and their freedom, and they will not be intimidated," said Charles LiMandri, chief counsel for FCDF.
DFEH officials had previously demanded a court order that would have forced Miller to create wedding cakes for everyone or no one at all. Superior Court Judge David Lampe ruled in Miller's favor in March. Lampe also ruled that his judgment was final last month, but gave the DFEH authority to continue to investigate.
Mediation between Miller and the couple is scheduled to take place on Monday, October 15.
