Steve Gilmore, the Lebec man who shot and killed Benito Carrillo outside of his home in December 2015, was sentenced to six years in prison for voluntary manslaughter.
Gilmore had been facing first-degree murder charges before taking a plea deal for the lesser charge of voluntary manslaughter.
Gilmore told police that he had seen Carrillo peering through his nine-year-old daughter's window before going back into the house to retrieve a shotgun.
Gilmore told Carrillo to get on the ground but police reports say Carrillo began to flee the scene.
Gilmore says that Carrillo then reached towards his waistband and that is when Gilmore shot him.
Police reports show that Carrillo did not have a weapon and he may have reached for his pants because they were falling down, which were around his ankles when police found him dead in the street from a gunshot wound to the head.
