District Attorney's office decides not to file charges against ICE agents involved in fatal crash

The District Attorney's office announced on Wednesday that charges will not be filed against the Immigrations Enforcement Agents who were involved in a fatal crash in Delano.

The Delano Police Department asked the D.A.'s office to file charges against the ICE agents for allegedly providing false information to officers. The department says agents told investigators they did not use emergency lights on their unmarked vehicles while they were following the victims.

Surveillance video obtained by Delano police shows the agents did use emergency lights during the incident, the department said.

District Attorney Lisa Green determined that there wasn't enough evidence to show that Agent Benitez and Agent Sanchez were in violation of the charges presented.

According to Delano police, Santo Hilario Garcia, 35, and Marcelina Garcia Profecto, 33, died last month after attempting to escape from ICE Agents.
