A man Kern County Sheriff officials say was shot by deputies after he charged at a deputy from behind in an apparent ambush was set to appear in court Thursday.

Ricardo Enrique Usher is facing felony assault charges and a misdemeanor for resisting arrest. He is still in the hospital according to the judge so his hearing was continued.

According to KCSO, the call came in early Monday morning for a suspicious vehicle in the area of Moneta and North Chester Avenue. A single deputy was the first on the scene and approached the vehicle after discovering it had been reported stolen.

The man, later identified as 31-year-old Usher, charged at the deputy resulting in Usher getting shot.

The deputy is currently on administrative leave.

Usher's bail is set at $500,000 and his new court date has been set for September 23rd.
