With the recent order from Governor Gavin Newsom to close indoor services for businesses such as restaurants and movie theaters, some local businesses are providing dine-out services.

A permit is required for those services though. So 23ABC asked public health if setting up an enclosed tent outdoors with air conditioning would violate the order. Public health officials say yes it would violate the state's new requirements. It must be outdoor with fresh air circulation.

According to public health setting up a tent would by default create an indoor space outdoors.
